1. Agreement to Terms

By accessing or using B2ARocket ("the Service"), operated by B2ARocket ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.

2. Description of Service

B2ARocket is an AI-powered B2B sales automation platform. The Service uses artificial intelligence agents to analyze business documents, build targeting strategies, discover and enrich leads, generate personalized email campaigns, manage outreach delivery, classify and respond to replies, and facilitate meeting bookings. The Service is provided on a subscription basis and is intended for business use.

3. Account Registration

You must create an account to use B2ARocket. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must notify us immediately at hello@b2arocket.com if you suspect unauthorized access.

We strongly recommend enabling multi-factor authentication (MFA) for your account. Organizations may have multiple members with different roles (Owner, Admin, Manager, Viewer), each with different access levels.

4. Acceptable Use

You agree to use B2ARocket in compliance with all applicable laws and regulations. You must not:

Send unsolicited bulk email (spam) or violate the CAN-SPAM Act, GDPR, or any other applicable anti-spam or data protection legislation.
Upload or transmit malicious content, including viruses, malware, or content designed to exploit system vulnerabilities.
Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
Use the Service to harass, threaten, defame, or discriminate against any person.
Misrepresent your identity or affiliation when sending email through the platform.
Scrape, reverse-engineer, or attempt to extract the source code of the Service.
Resell, sublicense, or redistribute access to the Service without written consent.
Use the Service in a manner that could damage, disable, overburden, or impair our infrastructure.

All outbound emails sent through B2ARocket must include a valid unsubscribe mechanism. The platform provides CAN-SPAM compliant unsubscribe links automatically. You are responsible for honoring unsubscribe requests promptly.

5. Your Data & Content

You retain ownership of all data you upload to B2ARocket, including documents, lead information, and email content. By using the Service, you grant us a limited license to process your data as necessary to provide the Service — including transmitting it to third-party AI and email providers as described in our Privacy Policy.

You are responsible for ensuring you have the right to use and upload any data you provide, and that your use of the Service complies with applicable data protection laws including GDPR and CCPA.

6. AI-Generated Content

B2ARocket uses AI to generate targeting strategies, lead analysis, email drafts, and reply responses. AI-generated content is provided as suggestions and may contain inaccuracies. You are responsible for reviewing and approving all AI-generated content before it is sent or acted upon. We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

7. Billing & Subscriptions

7.1 Plans & Pricing

B2ARocket is offered in tiered subscription plans (Starter, Growth, Scale, Enterprise). Pricing and feature limits for each plan are described on our website. We reserve the right to modify pricing with 30 days' notice to active subscribers.

7.2 Payment

Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method. All fees are stated in US dollars and are non-refundable unless otherwise required by law.

7.3 Overdue Payments

If a payment fails, we may downgrade or suspend your account. We will attempt to notify you before taking action. Past-due accounts may be subject to service restrictions until payment is resolved.

7.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then. No partial refunds are provided for unused time.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided "as is." We may perform scheduled maintenance, deploy updates, or experience outages beyond our control. We do not provide formal Service Level Agreements (SLAs) unless separately agreed in an Enterprise plan.

9. API Access & Integrations

B2ARocket provides API keys and webhook integrations for programmatic access. API keys are subject to rate limits and scope-based permissions. You are responsible for securing your API keys and rotating them regularly. We may revoke API access if usage violates these terms or threatens platform stability.

10. Intellectual Property

The B2ARocket platform, including its software, AI agents, algorithms, design, and documentation, is owned by B2ARocket and protected by intellectual property laws. These terms do not grant you any rights to our intellectual property beyond the limited license to use the Service as described here.

11. Limitation of Liability

To the maximum extent permitted by law, B2ARocket shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim under these terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold B2ARocket harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights — including claims related to emails sent through the platform or data you uploaded.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, non-payment, or any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period to comply with legal obligations, after which it will be deleted. You may request data export before account termination.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, that leads discovered will be valid, or that emails sent will be delivered.

15. Governing Law & Disputes

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.

16. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the revised terms on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms. If you do not agree with the changes, you must stop using the Service.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
